Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Sorted mobile application ("App") operated by Sightful ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use the App.

2. Description of Service

Sorted is a personal asset management application that allows you to:

• Catalog and track your physical belongings
• Use AI to identify and value items
• Monitor the total value of your assets
• Create and share public listings for items you wish to sell

3. User Accounts

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activities under your account

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement.

4. Acceptable Use

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Upload content that infringes on intellectual property rights
• Upload false, misleading, or fraudulent information
• Attempt to gain unauthorized access to our systems
• Use the App to harass, abuse, or harm others
• Upload content that is obscene, offensive, or inappropriate
• Use automated systems or bots to access the App
• Interfere with or disrupt the App or servers

5. User Content

You retain ownership of content you upload to the App ("User Content"). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for the purpose of providing the App services.

When you create a public listing, you grant us permission to display that content publicly on our website.

You are solely responsible for your User Content and represent that you have the right to upload it.

6. AI Features and Valuations

The App uses artificial intelligence to help identify products and suggest values. You acknowledge that:

• AI-generated information is provided for informational purposes only
• Valuations are estimates and may not reflect actual market value
• We do not guarantee the accuracy of AI-generated content
• You should verify important information independently

7. Listings and Transactions

When you create a public listing to sell an item:

• You are responsible for the accuracy of listing information
• You are responsible for any transactions that occur
• We do not facilitate payments or guarantee transactions
• We are not a party to any sale or purchase agreement

We reserve the right to remove listings that violate these Terms or are reported as fraudulent.

8. Intellectual Property

The App, including its design, features, and content (excluding User Content), is owned by Sightful and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Use our trademarks without permission
• Remove any copyright or proprietary notices

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The App will be uninterrupted or error-free
• The App will meet your specific requirements
• Any information provided is accurate or complete
• The App is free from viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIGHTFUL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or business opportunities
• Damages arising from use or inability to use the App
• Damages from transactions with third parties
• Reliance on AI-generated information or valuations

Our total liability shall not exceed the amount you paid us in the past 12 months, or CHF 100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Sightful and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App, your User Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. You may terminate your account at any time by deleting your account through the App.

Upon termination, your right to use the App will immediately cease. Sections that by their nature should survive termination will survive.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Switzerland.
